A juíza Luciana Raquel Tolentino de Moura, da 7ª Vara Federal de Brasília, decidiu nesta quarta-feira (15) não analisar a ação da Ordem dos Advogados do Brasil (OAB) que pede a suspensão da cobrança por saldo do cheque especial não usado.
No entendimento da juíza, cabe ao Supremo Tribunal Federal (STF) analisar o pedido porque o partido Podemos já apresentou uma ação semelhante à Corte.
As ações questionam a resolução do Banco Central que passou a permitir a cobrança de tarifa de 0,25% sobre o cheque especial de quem não utiliza o limite. A regra entrou em vigor em janeiro deste ano.
“Detectada a conexão entre as ações, elas devem ser reunidas, a teor do § 1º do art. 55 do CPC, a fim de evitar decisões contraditórias, bem como, in casu, para que se preserve a competência originária do STF”, escreveu a juíza na decisão.
Começam a valer as novas regras do cheque especial

Pelas normas, quem tem mais de R$ 500 de limite no cheque especial terá de pagar até 0,25% sobre o valor excedente. A tarifa pode ser cobrada até mesmo se o cliente não utilizar o limite do cheque especial.
A OAB entendeu que há violação ao direito do consumidor na cobrança do percentual. “O consumidor não pode ficar sujeito à cobrança de tarifa pela disponibilização de cheque especial, independentemente da efetiva utilização do serviço”, afirma a ação.
Segundo a Ordem, a cobrança de tarifa “claramente coloca o consumidor em uma situação de desvantagem exagerada, ao arcar com um gravame por algo de que não usufruiu, o que desequilibra a relação contratua””.
As alterações foram aprovadas em novembro passado pelo Conselho Monetário Nacional. Até então, não havia limite para a taxa do cheque especial.
