Um tribunal americano condenou as empresas alemãs Bayer e Basf a pagar US$ 265 milhões a um agricultor que denunciou que os herbicidas das empresas destruíram suas colheitas de pêssegos.
Por que a produção de alimentos depende tanto de agrotóxicos?
O júri do tribunal federal de Cape Girardeau, no estado do Missouri, anunciou a sentença após uma denúncia de Bill Bader, que alegava que as duas empresas estimulavam os agricultores a usar o herbicida dicamba, um dos mais vendidos nos EUA, de forma irresponsável.
O dicamba é um herbicida popular, mas polêmico, pois tende a matar as plantações nos campos vizinhos onde é utilizado. Expande facilmente e acaba com as plantas que não estão adaptadas ao produto.
De acordo com a agência Bloomberg, este foi o primeiro julgamento nos Estados Unidos sobre o pesticida dicamba, que está há muitos anos no mercado.
Agricultores de várias regiões dos Estados Unidos processaram a Bayer pelos prejuízos sofridos por culpa do dicamba.
A decisão judicial acontece depois de outro caso no qual a Bayer foi condenada por júri da Califórnia a pagar US$ 290 milhões a um jardineiro que tem um câncer incurável.
A sentença foi motivada pelo fato da empresa não ter informado de maneira suficiente sobre o perigo do RoundUp, à base de glifosato, outro pesticida polêmico.
Bayer, que afirma que o dicamba é inócuo para as plantações caso os agricultores sigam as instruções, anunciou em um comunicado que pretende apelar contra a sentença o mais rápido possível.
A Basf também anunciou que deseja “utilizar todos os meios legais à disposição” para contestar a decisão, afirmou um porta-voz da empresa.
A Bayer comprou em 2018 o grupo americano Monsanto e teve que vender para a BASF parte de suas atividades agroquímicas para respeitar as normas de concorrência.
