Ministra é relatora de uma ação do PT que questionou os atos do Conama. Retirada de proteção de manguezais e restinga foi suspensa por outra decisão, da Justiça Federal do Rio de Janeiro. A ministra Rosa Weber, do Supremo Tribunal Federal, determinou que o ministro do Meio Ambiente, Ricardo Salles, preste informações em 48 horas sobre a decisão do Conselho Nacional do Meio Ambiente (Conama), que revogou regras que protegiam áreas de manguezais e de restingas.
A deliberação do Conama, na última segunda-feira (28), está suspensa por uma determinação da Justiça Federal do Rio de Janeiro. O ato também foi questionado no Supremo, pelo PT. Rosa Weber é a relatora da ação.
“Diante da urgência qualificadora da tutela provisória requerida e da relevância do problema jurídico-constitucional posto, requisitem-se informações prévias ao Ministro de Estado do Meio Ambiente , a serem prestadas no prazo de 48 horas. Dê-se ainda vista ao Advogado-Geral da União e ao Procurador-Geral da República, no mesmo prazo”, ordenou a ministra.
Atos do Conama
Os atos do Conama que estão em disputa na Justiça são:
a revogação de uma resolução que obrigava os projetos de irrigação a terem licença ambiental.
a revogação de duas resoluções que restringiam o desmatamento em áreas de preservação permanente com vegetação nativa, como restingas, manguezais e mananciais urbanos.
Na mesma reunião, o conselho também aprovou uma nova resolução autorizando a queima de lixo tóxico em fornos para produção de cimento, o que segundo especialista, apresenta riscos de contaminação pelas populações locais.
O Conama é responsável por estabelecer as diretrizes para licenças ambientais e normas para manter a qualidade do meio ambiente. Essas normas têm força de lei. Reúne representantes do governo e também da sociedade civil. Mas um decreto do presidente Jair Bolsonaro encolheu a participação da sociedade civil: de 22 votos para quatro.
Em 2019, o Conama reduziu sua composição de 96 para 23 conselheiros. O restante das vagas é ocupado por entidades empresariais e representantes de governos. O governo federal e governos estaduais ocupam mais de dois terços das cadeiras.
As mudanças na composição do Conama também são alvo de questionamento no Supremo desde o ano passado.
