A decisão do Supremo Tribunal Federal (STF), nesta quinta-feira (26), de confirmar a constitucionalidade da lei que aprovou a independência do Banco Central teve nos bastidores um trabalho intenso do presidente da instituição, Roberto Campos Neto.
Desde que PT e PSOL acionaram o STF para declarar a inconstitucionalidade da lei aprovada no Congresso – e ainda mais, depois do parecer da Procuradoria-Geral da República no mesmo sentido –, Campos Neto passou a fazer “corpo a corpo” com os ministros do Supremo.
O presidente do BC se reuniu com mais da metade dos membros da corte – com alguns, mais de uma vez.
Relatos ouvidos pelo blog dentro do STF apontam que a argumentação de Campos Neto girava em torno do avanço institucional que a independência traria ao país, da maior segurança para investidores e da equiparação com o que países desenvolvidos e estáveis têm atualmente.
O plenário do Supremo começou a julgar o tema na quarta e concluiu a análise nesta quinta. Veja detalhes abaixo:
STF retomou julgamento sobre autonomia do Banco Central
Poucos dias depois de o Procurador Geral da República, Augusto Aras, responder ao STF indicando que concordava com a tese de vício na origem do projeto que deu a BC autonomia, Campos Neto já se reunia com o presidente do STF, Luiz Fux.
Nas semanas seguintes, intensificou as reuniões. Almoçou com Dias Tofolli, fez reuniões presenciais ou por teleconferência com Luiz Roberto Barroso, Alexandre de Moraes, Carmen Lúcia e duas vezes com Gilmar Mendes.
Todos os ministros que se reuniram com Campos Neto votaram a favor da validade da lei aprovada no Congresso. O relator no STF, Ricardo Lewandowski, votou pela inconstitucionalidade. Primeiro a votar, chegou a dizer durante a leitura que sabia que seria vencido. Apenas Rosa Weber acompanhou o relator.
O STF não debateu a autonomia do Banco Central em si – mas irregularidades na tramitação do projeto, que não partiu do Executivo, mas do próprio Congresso.
O tema também esteve presente em reuniões de Campos Netocom os presidentes do Senado e da Câmara, com a Advocacia-Geral da União e com o ministro da Economia, Paulo Guedes.
Os ministros do STF aproveitaram os encontros para ouvir o presidente do BC sobre as perspectivas da economia brasileira.
O blog ouviu relatos de que os magistrados gostaram de escutar Campos Neto, em especial pela sinceridade e pelos alertas de que, sem estabilidade institucional no país, a economia vai seguir sofrendo consequências como menor crescimento e dificuldade de retomada.
